Refund Policy

Important Notice

Please read this policy carefully before purchasing our services.

Due to the nature of document preparation and filing services, refunds are limited once work has begun. State filing fees paid to government agencies are non-refundable under all circumstances.

1. Service Fees vs. State Fees

Our charges consist of two types of fees:

  • Service Fees: Fees paid to SwyftForm for document preparation, filing services, and other services we provide
  • State Fees: Government filing fees required by state agencies that we collect and remit on your behalf

These fees are clearly separated on your invoice. This refund policy applies differently to each type of fee.

2. State Filing Fees - Non-Refundable

State filing fees are 100% non-refundable once paid to the government agency. This includes:

  • Articles of Organization filing fees
  • Amendment filing fees
  • Annual report fees
  • Expedited processing fees paid to the state
  • Certificate fees
  • Any other government agency fees

We act as an intermediary to submit these fees to state agencies. Once submitted, these fees cannot be recovered, even if:

  • You change your mind about forming an LLC
  • The state rejects your filing for any reason
  • You decide to use a different business name
  • You make errors in the information provided

3. Service Fee Refunds

3.1 Before Work Begins

You may request a full refund of service fees if:

  • You cancel within 24 hours of purchase
  • We have not yet begun work on your order
  • No documents have been prepared or filed

3.2 After Work Begins

Once we begin work on your order, service fees are generally non-refundable. Work is considered to have begun when:

  • We conduct a business name search
  • We prepare your formation documents
  • We submit filings to state agencies
  • We begin providing registered agent services
  • We submit your EIN application

3.3 Partial Refunds

In certain circumstances, we may offer partial refunds:

  • If we are unable to complete a service you paid for due to our error
  • If we significantly delay service delivery beyond promised timeframes due to our fault
  • If you purchased a package but only some services were completed

Partial refunds are calculated based on the value of services not rendered.

4. State Rejections and Errors

4.1 Rejections Due to Customer Error

If the state rejects your filing due to incorrect or incomplete information you provided:

  • State fees are non-refundable
  • Service fees are non-refundable
  • Additional fees apply for resubmission
  • New state fees required for resubmission

4.2 Rejections Due to Our Error

If the state rejects your filing due to our error in preparation or filing:

  • We will correct and refile at no additional service fee
  • We will cover any additional state fees if required
  • If you prefer not to refile, we will refund our service fees
  • State fees already paid are still non-refundable

5. Registered Agent Service Refunds

Registered agent service fees are:

  • Charged annually in advance
  • Refundable on a pro-rata basis if you cancel mid-year
  • Subject to a $25 administrative fee for processing cancellations
  • Not refundable for the first 30 days of service

Example: If you paid $119 for annual registered agent service and cancel after 6 months, you would receive a refund of approximately $35 (remaining 6 months minus $25 admin fee).

6. Compliance Services Refunds

Compliance monitoring and annual report services:

  • Annual fees are non-refundable once the service year begins
  • If we fail to send required notifications, we will refund the monitoring fee
  • Filing fees for annual reports follow the same rules as formation filing fees

7. How to Request a Refund

To request a refund:

  1. Email info@swyftform.com with your order number
  2. Provide a detailed explanation of why you are requesting a refund
  3. Include any supporting documentation
  4. We will review your request within 5 business days
  5. If approved, refunds are processed within 10 business days

Required information:

  • Full name and email address on the account
  • Order number or invoice number
  • Date of purchase
  • Specific services for which you're requesting a refund
  • Reason for refund request

8. Refund Processing

Approved refunds are processed as follows:

  • Refunds issued to the original payment method
  • Credit card refunds appear within 5-10 business days
  • Bank transfers may take up to 10 business days
  • You will receive email confirmation when refund is processed

9. Disputes and Chargebacks

Before initiating a chargeback with your credit card company:

  • Please contact us first to resolve the issue
  • Most concerns can be resolved quickly through direct communication
  • Chargebacks may result in suspension of services
  • If a chargeback is filed, we may be unable to complete pending services

10. Satisfaction Guarantee

While our refund policy is limited due to the nature of our services, we stand behind our work:

  • We guarantee accurate preparation of your documents based on information you provide
  • We guarantee timely filing with state agencies
  • We guarantee professional and courteous service
  • If we fail to meet these standards, we will make it right

11. Exceptions

This refund policy does not affect your statutory rights under consumer protection laws. Some states may provide additional refund rights beyond what is stated here.
